Privacy notice

01Who processes your data

LIONHEAD, S. de R.L. de C.V., with the commercial name Lionhead Marketing, is the data controller ("responsable") for the processing of the personal data you provide to us, and for the use we make of it.

We publish this notice in compliance with the Ley Federal de Protección de Datos Personales en Posesión de los Particulares (LFPDPPP, Federal Law on the Protection of Personal Data Held by Private Parties), its Regulations and the Lineamientos del Aviso de Privacidad (Privacy Notice Guidelines).

02What data we collect

We only ask for what is necessary to reply to you and to work with you. When you fill in a form on this site, write to us on WhatsApp or send us an email, we collect:

• Identification and contact data: name, email address, telephone or WhatsApp number.
• Data about your company: business name, line of business, website and what you tell us about your marketing situation.
• Billing data: only if we end up working together, razón social (registered company name), RFC (Mexican tax ID), tax regime and tax domicile.
• Browsing data: those generated by your visit to the site, described in point 8.

We do not collect sensitive personal data. We do not ask you for information on health, ethnic origin, religious beliefs, political opinions or sexual preference, and you do not need to give it to us.

If we access your company’s advertising, analytics or social media accounts as part of a contracted service, the services agreement governs that access, not this notice, and the accounts always remain in your name.

03What we use it for

Primary purposes. These are the ones that give rise to our relationship with you and they are necessary. If you object to these, we cannot assist you:

• Answering your request for information, a quote or a diagnosis.
• Preparing proposals and estimates.
• Providing the services you may contract and following up on them.
• Invoicing, collecting payment and complying with tax and accounting obligations.
• Handling clarifications, complaints or requests related to the service.

Secondary purposes. These are not necessary in order to assist you, and you may refuse them without that affecting the service:

• Sending you marketing content, blog articles or agency news.
• Inviting you to events, webinars or training sessions.
• Conducting satisfaction surveys and internal studies to improve the service.

To refuse the secondary purposes, an email to [email protected] with the subject line "Finalidades secundarias" (secondary purposes) is enough. You have five business days from the moment we make this notice available to you to state your refusal, and you may do so at any time afterwards.

04How to limit the use or disclosure of your data

In addition to refusing the secondary purposes, you may ask us to stop using your data for commercial communications:

• Through the unsubscribe link at the bottom of every email we send you.
• By writing to [email protected].
• By requesting it on WhatsApp at 81 2152 8086.

We apply the removal within the following five business days. We do not keep a public exclusion registry, but you may register with the Registro Público de Consumidores (Public Consumer Registry) of the Procuraduría Federal del Consumidor (Federal Consumer Protection Agency).

05Your ARCO rights

You have the right to access your data, to rectify it if it is wrong, to cancel it when it is no longer necessary and to object to our using it for specific purposes. The law calls them ARCO rights (access, rectification, cancellation and opposition).

To exercise them, send us an email to [email protected] with the subject line "Derechos ARCO" (ARCO rights) and this information:

• Your name and an email address or telephone number where we can reply to you.
• A copy of an official identification document. If you are acting on behalf of someone else, the document that proves it.
• Which data you want to access, correct or cancel, or which use you object to.
• If you request a rectification, the documentation supporting the correct data.

We communicate the response within a maximum term of twenty business days from the moment we receive the complete request. If it is well founded, we make it effective within the following fifteen business days. Exercising these rights is free of charge, and you would only cover shipping or copying costs if there were any.

The law allows us not to cancel certain data. Tax receipts, for example, must be kept for the term set by the legislation. When this happens, we tell you and we explain why.

06Revoking your consent

You may withdraw at any time the consent you gave us to process your data, through the same means described in point 5. In some cases we cannot delete everything immediately, because the law requires us to keep certain information. When that happens, we explain it to you.

07Who we share it with

We do not sell, rent or trade your personal data.

What you write in the forms on this site arrives at [email protected]. We do not send it to any other platform.

We do use third-party tools to operate, and they store and process your data. They act as data processors ("encargados") and may only process it following our instructions:

• Google Workspace: the agency’s email lives there, so the messages you send us are stored there. We measure the site with Google Analytics.
• The hosting provider of this site, where the WordPress database lives. A copy of what you send through a form is stored there.

Some of these services have servers outside México, so they may store your data in other countries. We choose providers with equivalent protection conditions.

Apart from those data processors, we only share data when a competent authority requires it by law. If any other transfer requires your consent, we ask you for it beforehand and expressly.

08Cookies and measurement

This site uses cookies to function, to remember your preferences and to measure traffic with Google Analytics 4. Google delivers that data to us in aggregate form, without identifying you.

You may disable or delete cookies from your browser settings. If you do, some parts of the site may stop working as you expect.

09How we protect it

We maintain reasonable administrative, technical and physical security measures to protect your data against damage, loss, alteration, destruction or unauthorized use. Among others: access restricted to those who need it for their work, passwords and authentication in the tools where the data lives, and an encrypted connection on this site.

Even so, something can fail. If a breach occurs that affects your rights, we inform you so that you can take measures.

10Changes to this notice

This notice may change if our services, our tools or the law change. The version in force is the one published at marketinglh.com/aviso-de-privacidad/, with its date at the top.

If the change is significant and affects how we process your data, we notify you by email at the address you have given us.

11If you are not satisfied

If you believe that we violated your right to the protection of personal data, or that we responded badly to your request, you may turn to the Instituto Nacional de Transparencia, Acceso a la Información y Protección de Datos Personales (INAI) (National Institute for Transparency, Access to Information and Personal Data Protection).

Before that, write to us. We prefer to resolve it by email.
